A federal judge has ruled an Indiana prison must provide transgender surgery to an inmate convicted of killing a baby.
Jonathan Richardson, a 42 year old man who now identifies himself as a woman, was convicted in 2001 for fatally strangling his 11 month old step-daughter. He’s currently serving a 55 year prison sentence.
The ACLU sued, demanding Indiana taxpayers pay for his transgender genital surgery.
District Court Judge Richard Young ruled that it was “cruel and unusual punishment” for the state to deprive Richardson of this surgery. Indiana’s Attorney General will appeal the decision.
